Court orders stay of proceedings on suit seeking to stop conduct of ward congress in Rivers


A Rivers State High Court sitting in Port Harcourt has stayed further proceedings on suit instituted by Stephen Wonah and six others aggrieved members of the All Progressives Congress against the party and it’s state and Abbot-Ogbobula pending the determination of appeal by the APC.

Justice O Ben-whyte made the decision to stay proceeding on the matter on Thursday after counsel to APC, Tuduru Edeh, (SAN) informed the court about a pending appeal on the earlier decision of the court for parties to maintain status quo before the conduct of the ward Congress on Saturday 21 July, 2021.

Claimants counsel, Henry Bello had in his argument asked the court to dismissed application for stay of proceeding by the defendant counsels.

He argued that the appeal is not ripe for hearing, praying the court to go ahead and hear the suit.

The presiding judge Justice Ben-Whyte in his ruling, explained that it would amount to abuse of court process if he goes ahead to hear the matter in which an appeal has been entered.

The judge thereafter adjourned the matter indefinitely pending the determination of the court of appeal.
